User Contract
Welcome to HiColor Graphics. Please review the following basic rules that govern your use of the HiColor Graphics site.
HiColor Graphics reserves the right to update or modify these Terms and Conditions at any time without prior notice to you. Your use of the Site following any such change constitutes your unconditional agreement to follow and be bound by these Terms and Conditions as changed. For this reason, we encourage you to review these Terms and Conditions whenever you use this Site.

Pricing
Pricing is subject to change at any time up until the point that your order is submitted.

Quotation
Quoted turnaround time begins when you receive your email verifying that we have received your order. A Custom quotation not accepted within 30 days may be changed.

Payment
If a user submits a request on the site to purchase printing products, design services or other services, the user agrees that all charges, taxes and shipping/handling fees will automatically be charged to the credit card or paid by user with an approved payment method. We require each order to be fully paid, including shipping and handling fees, if applicable, before we complete an order. We will not start working on a print job until we receive the full payment. Once a print job has been approved by customer and "sent to press" on the site, no changes are allowed to the artwork files, job characteristics, or printing turnaround time.

Refund & Cancellation Policy
Cancellations are accepted in writing up until payment information has been completed. Cancellations after completed transaction will result in your incurring any charges for labor and materials up to the point when we received your written notification. If the job is already printed by this time, you are liable for the full cost.
Refunds usually are not possible once HiColor Graphics begins work on your order. Work will only begin after payment has been made, artwork files uploaded, and job proofs approved.
If we verify that HiColor Graphics has made an error, we will re-run the order, however we are not responsible for errors in your print files.
If you find a defect in your job, which is the responsibility of HiColor Graphics, we will re-run the order at no additional cost to you.
In some cases, a partial or full refund may be extended to you if no work has been completed by HiColor Graphics for a specific order. Such refund would be adjusted to cover any fees charged for proofs or other services associated with that order.
Each order made from HiColor Graphics is a contract between you, as the customer making the order, and HiColor Graphics. Orders placed on behalf of a third party are still your responsibility. As such, any decision by the third party not to accept the particular printed items, or to cancel the order with you does not affect your obligation to HiColor Graphics.

Turnaround Times
Orders placed after 10 am EST on any business day will begin production the following business day. This is true for file proofs, corrections and printing. Orders placed on Saturday or Sunday will be processed on Monday. Turnaround time begins with the receipt of your files, either electronically or on a disc. In the event that production schedules are not adhered to by the customer, delivery dates will change. We generally preflight files for new projects and produce a proof within 1 business day of receipt of the order. If there is a problem with your files or missing components, we will contact you immediately. Once you approve a final proof, complete the payment information printing will proceed in accordance with the production schedule agreed upon in your quote.
80lb. Gloss Book: additional 4 business days.
100lb. Gloss Cover: additional 3 business days.
70lb. Offset Opaque Smooth White: additional 2 business days.
Recycled Paper: additional 3 business days.
Quantity Over 50K: additional day per 10k.

Corrections
Any additional translating, editing or programming needed on customer-supplied files can be completed by the customer or HiColor Graphics will make the corrections at the rate of $40/hour. HiColor Graphics will preflight all digital files received from the customer to determine if they are print ready. If corrections are needed, we will contact you immediately and give you the option of making the changes and sending us new files or having us make the changes.

Artwork Files
Our prepress department checks all submitted artwork files before printing, but you are still 100% responsible for the accuracy of your print-ready artwork files, and we encourage you to proofread all files carefully before submitting to HiColor Graphics. HiColor Graphics is not responsible for any issues as to orientation or alignment of the pages of your submitted documents. By submitting the artwork to HiColor Graphics, you certify that you have the right to use the image(s) in your artwork files.

Proofs
Customers are 100% responsible for the accuracy of your layouts and are encourage to proof each job carefully.
If requested, an online proof will be available for your review after we have received your file upload. No job will be sent to press without your approval. It is the customer’s responsibility to log in to their account and check on their proof. We are not liable for delays in the order caused by customer's non-approval of the proof.
An online proof is by no means an accurate color reproduction of your final printed piece but is the final opportunity for you to check the layout, bleeds, crops and final text.
HiColor Graphics offers hard copy proofs which show reasonable likeness to the final printed pieces. Such proofs are recommended for color-critical art and must be requested by the customer when the print order is made.

Shipping and Handling
Delivery is quoted for a single shipment, without storage, F.O.B. the customer's premises according to the shipping information supplied by the customer.
Our normal shipping method is UPS ground. Rates are available for ground, next day air, 2 day and 3 day shipping within the continental US. Shipments to more than one address may require additional shipping and handling charges for each location.
Once a package has shipped, HiColor Graphics will not be responsible for late or damaged packages. Delivery dates are not guaranteed and may include extra transit time in case of unforeseen delays. No refund on shipping charges will be made on any job once it has shipped.

Sales Tax
All Tennessee orders are subject to sales tax. If a customer is tax exempt, a copy of the exemption certificate must be sent or faxed to us with the first job ordered.

Satisfaction Guarantee
HiColor Graphics is committed to delivering quality printing in accordance with Industry Standards. Therefore, we guarantee that if your job has defects in workmanship or materials within our control or if we fail to follow your written instructions, we will reprint the job at our expense upon receipt of returned merchandise.
This guarantee does not apply to errors in customer-supplied digital files, including, but not limited to, poor or low resolution photographs, improper color model, missing fonts, defective file formats, incorrect copy or corrections that were not noted on your proof approval form.
If you feel your final, printed job does not meet your specifications and that the error is due to a defection workmanship or materials, you must notify HiColor Graphics in writing within 10 business days of receipt of the printed pieces.

Compliance with Laws
Member assumes all knowledge of applicable law and is responsible for compliance with any such laws. Member may not use the Service in any way that violates applicable state, federal, or international laws, regulations or other government requirements. Member further agrees not to transmit any material that encourages conduct that could constitute a criminal offense, give rise to civil liability or otherwise violate any applicable local, state, national, or international law or regulation.

All content included or available on this site, including but not limited to site design, text, graphics, interfaces, and the selection and arrangements thereof is 2010 HiColor Graphics, with all rights reserved, or is the property of HiColor Graphics and/or third parties protected by intellectual property rights. Any use of materials on the website, including reproduction for purposes other than those noted above, modification, distribution, or replication, any form of data extraction or data mining, or other commercial exploitation of any kind, without prior written permission of an authorized officer of HiColor Graphics is strictly prohibited. Members agree that they will not use any robot, spider, or other automatic device, or manual process to monitor or copy our web pages or the content contained therein without prior written permission of an authorized off Member assumes all knowledge of applicable law and is responsible for compliance with any such laws. Member may not use the Service in any way that violates applicable state, federal, or international laws, regulations or other government requirements. Member further agrees not to transmit any material that encourages conduct that could constitute a criminal offense, give rise to civil liability or otherwise violate any applicable local, state, national, or international law or regulation.
